Terms of Service

By accessing or using ViralRemix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

ViralRemix is a SaaS platform that provides agencies and content creators with tools to discover viral content, analyze content frameworks, and generate AI-powered scripts adapted to client brand voices. The Service includes a viral content database, AI remix engine, competitor monitoring tools, and workspace management.

Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

Age Requirement

You must be at least 18 years old to use the Service. By using ViralRemix, you represent that you meet this requirement.

One Account Per User

Creating multiple accounts to circumvent plan limits, abuse free trials, or evade account restrictions is prohibited and will result in immediate termination of all associated accounts.

Workspace Access

You are responsible for all users you invite to your workspaces. Ensure that all team members comply with these Terms.

Permitted Use

You may use ViralRemix to create original content scripts inspired by viral frameworks, manage client brand voices, and monitor publicly available social media content for competitive intelligence.

Prohibited Activities

You may not: (a) use the Service for any unlawful purpose; (b) generate content that infringes third-party intellectual property rights; (c) use AI-generated scripts to plagiarize or pass off others' work as original without proper attribution where required; (d) attempt to reverse-engineer or scrape our systems; (e) resell or sublicense access to the Service without written permission; (f) use the Service to generate spam, misinformation, or harmful content; (g) circumvent any access controls or rate limits.

Content Responsibility

You are solely responsible for the content you create using ViralRemix. We provide tools to inspire and assist; the final content decisions and their legal compliance are your responsibility.

Your Content

You retain ownership of all original content you create using the Service, including brand voice profiles, custom prompts, and finalized scripts. By using the Service, you grant ViralRemix a limited, non-exclusive license to process your content to provide the Service.

Our Platform

All software, algorithms, databases, designs, and trademarks comprising the ViralRemix platform are the exclusive property of ViralRemix and its licensors. You receive no ownership rights, only a limited license to use the Service per these Terms.

AI-Generated Content

Scripts generated by our AI are provided for your use. We do not claim ownership over AI outputs. However, you acknowledge that similar outputs may be generated for other users using similar inputs.

Subscription Plans

ViralRemix offers Free, Starter, Growth, and Agency plans. Paid plans are billed monthly or annually. Plan details, including limits and pricing, are available on our Pricing page and may be updated with 30 days' notice.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorize us to charge your payment method on file for renewals.

Upgrades & Downgrades

Plan upgrades take effect immediately with prorated billing. Downgrades take effect at the next billing cycle. You will not be refunded for unused time on the current plan when downgrading.

Failed Payments

If a payment fails, we will retry up to three times over seven days. If payment cannot be collected, your account will be downgraded to the Free plan until payment is resolved.

Taxes

Prices do not include applicable taxes (VAT, GST, etc.). Taxes will be calculated and added at checkout based on your billing location.

By You

You may cancel your subscription and close your account at any time from the Settings page. Cancellation stops future charges but does not entitle you to a refund for the current billing period (see our Refund Policy).

By ViralRemix

We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms, engage in fraud, or if required by law. We may also terminate accounts that have been inactive for more than 12 months on a Free plan.

Effect of Termination

Upon termination, your license to use the Service ceases immediately. Your data will be retained for 30 days to allow reactivation, after which it will be permanently deleted per our Privacy Policy.

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS OBTAINED WILL BE ACCURATE OR RELIABLE.

AI Content

AI-generated content is provided for inspiration and efficiency. We do not guarantee the accuracy, originality, or suitability of AI outputs for any particular purpose. Always review AI-generated content before publishing.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALREMIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the jurisdiction in which ViralRemix is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.
